Dear AALL Members,

The battle over the two competing House bills to protect databases is heating up. AALL supports the Commerce Committee's "Consumer and Investor Access to Information Act of 1999" (H.R. 1858; House Report 106-350 Pt. 1), that contains the following exclusion proposed by AALL.

AALL AMENDMENT:

Section 104(f): Protection under this chapter shall not extend to primary legal materials, including court opinions, statutes, codes, regulations, or administrative agency decisions, from any Federal, state, or local jurisdiction, unless such materials were permanently available on an interactive computer network, without restriction, in an official, no-fee, publicly accessible electronic form at the time that the extraction occurred.

MORE COSPONSORS URGENTLY NEEDED:

There are currently ONLY 18 cosponsors to H.R. 1858, and many more are needed!

On the other hand, there are 65 cosponsors to the Judiciary Committee's legislation, the "Collections of Information Antipiracy Act of 1999" (H.R. 354, House Rept. 106-349 Pt. 1) that we strongly oppose.

The fight over these bills will be on the House floor, and your help is needed IMMEDIATELY to get additional cosponsors and to ensure the solid support of your representative for H.R. 1858.

The gist of the message, from our August 4th letter to Commerce Committee Chairman Bliley, is that:

"AALL supports H.R. 1858 because it does not overturn the Feist decision, thereby affirming a basic tenet of U.S. information policy that facts are in the public domain. We recognize the need to exclude primary legal materials and are very pleased with the new language of Section 104(f). We fear that if legal information falls under a new database protection regime, then Congress will have denied all Americans one of the most fundamental rights of our democracy, access to the law of the land. We are pleased that academic users and others would benefit from H.R. 1858's permissible uses, patterned after traditional copyright "fair use" provisions, and that this legislation permits transformative uses of data that are critically important to electronic commerce and to the creation of new information products."

ACTION NEEDED NOW!

The lists of cosponsors for each bill follows. If your representative is already a cosponsor of H.R. 1858, THANK them and URGE them to help get others to cosponsor this important legislation!

If your representative is not a cosponsor of H.R. 1858, FAX them a letter (feel free to cut and paste from AALL letters), and ALSO FAX them our Issue Brief: Rule of Law. Urge them to cosponsor H.R. 1858 now.

Follow-up with a phone call, letting them know how important an issue this is for their constituents. Chapter letters are very important as well and carry a lot of weight!

Getting our amendment into H.R. 1858 was a victory, but our efforts are needed now more than ever before! Let's make sure that members of the House of Representatives hear very loudly that AALL members strongly support H.R. 1858.
